The Gymnastics TeamHub

These Terms of Service ("Terms") constitute a legally binding agreement between you and Two Trees Software LLC ("Company," "we," "us," or "our") concerning your access to and use of The Gymnastics TeamHub mobile application and web platform (the "Service"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for managing your gymnastics program or organization.

You must be at least 13 years of age (or 16 years of age in the European Union) to create an account and use the Service. By creating an account, you represent that you meet this age requirement. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access to or use of your account.
We reserve the right to suspend or terminate your account at any time for any reason, including if we believe you have violated these Terms. You may delete your account at any time through the account settings within the app or by contacting us at support@twotreesapps.com. Upon account deletion, your personal data will be removed in accordance with our Privacy Policy.
The Service is organized around organizations called "Hubs." Creating a Hub requires an active paid subscription through the web platform. Hub creators ("Hub Owners") are responsible for managing membership, permissions, and content within their Hub.
Any registered user may join an existing Hub at no cost by using an invite code provided by the Hub Owner or an authorized member. By joining a Hub, you agree to abide by any rules set by the Hub Owner in addition to these Terms.
Hub Owners may assign roles to Hub members (such as staff, coach, or member) that determine access to features and content within the Hub. Role-based permissions are managed by the Hub Owner through the web platform.
Hub Owners are responsible for ensuring they have appropriate consent to store personal information about minors (such as athlete profiles) and for managing access permissions within their organization.
Hub creation and subscription management are available only on the web platform. The mobile application allows users to join and access Hubs as members but does not support Hub creation or subscription purchases.
You retain all rights to the content you create, upload, or store in the Service, including gymnast profiles, scores, messages, photos, documents, and audio files ("User Content"). By using the Service, you grant us a limited license to store, process, and display your User Content solely for the purpose of providing the Service.
Content you share within a Hub (messages, posts, files) will be visible to other Hub members according to the permissions set by the Hub owner. You are responsible for the content you share and should not share sensitive information beyond what is necessary.

Your use of the Service is also governed by our Privacy Policy, available at teamhub-privacy.html. Please review the Privacy Policy to understand our practices regarding the collection, use, and disclosure of your information.
The Service, including all content, features, and functionality, is owned by Two Trees Software LLC and is protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws. "The Gymnastics TeamHub," "Gym TeamHub," and related logos are trademarks of Two Trees Software LLC.
The Service integrates with third-party services, including Supabase for data storage and authentication, Firebase for web hosting, Stripe for payment processing, and Expo/Firebase Cloud Messaging for push notifications. Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices or content of third-party services.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
TO THE FULLEST EXTENT PERMITTED BY LAW, TWO TREES SOFTWARE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OR INABILITY TO USE THE SERVICE. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED ONE HUNDRED DOLLARS ($100).
You agree to indemnify, defend, and hold harmless Two Trees Software LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your access to or use of the Service, your User Content, or your violation of these Terms.
We reserve the right to modify, suspend, or discontinue the Service at any time. We may update these Terms from time to time. If we make material changes, we will notify you by updating the "Last updated" date. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law provisions.
Any dispute arising out of or relating to these Terms or the Service shall first be resolved through good faith negotiations. If negotiations fail, you and Two Trees Software LLC agree to resolve the dispute through binding arbitration administered in the State of Illinois, except that either party may bring claims in small claims court if eligible.
You agree that any arbitration or court proceeding shall be conducted on an individual basis and not as a class action or representative proceeding. You waive any right to participate in a class action lawsuit or class-wide arbitration against Two Trees Software LLC.
If you access the Service via Google Play, you agree to comply with Google Play's Terms of Service, available at https://play.google.com/about/play-terms/.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Two Trees Software LLC regarding the use of the Service. If any provision is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
